3. How can I apply to come to Hong Kong as a dependant?

Applications for entry for residence in Hong Kong in the capacity of a dependant may be considered for approval by the State if the following working conditions are studied

the applicant and the sponsor are able to provide reasonable proof of relationship; and

The applicant has no known adverse record;

the sponsor is able to maintain the basic living conditions of the dependant in Hong Kong and provide him/her with a suitable place of residence.

4. Will dependants coming to Hong Kong under the Dependants Policy be restricted from pursuing studies in local schools?

No. All dependants are not required to study in Hong Kong without the prior approval of the Director of Immigration.

5. Can dependants admitted under the Dependants Policy work in Hong Kong?

Dependants of the following members of the community are allowed to take up employment in Hong Kong without certain restrictions:

Hong Kong permanent residents;

Hong Kong residents who are not subject to a limit of stay (i.e. those who have the right to land or may stay unconditionally);.

persons authorized to work in Hong Kong (as professionals, entrepreneurs or trainees coming to Hong Kong for investment); and

persons admitted to Hong Kong under the Capital Markets Investor Entrant Development Scheme, the Quality Migrant Admission Scheme for Management Personnel or the Admission of Second Generation of Hong Kong Permanent Residents of Chinese Nationality Scheme.

However, dependants of persons admitted for study in Hong Kong are not allowed to take up employment in Hong Kong without the prior approval of the Director of Immigration.

6. What are the eligibility criteria for applying for extension of stay in order to reside in Hong Kong as a dependant?

To apply for extension of stay as a dependant, the applicant must still meet the eligibility criteria for residence in Hong Kong as a dependant (including that the applicant will not lose the assurance due to a change in circumstances, e.g. change in the marital relationship between the dependent spouse and the sponsor or the death of the sponsor), and that the sponsor is still a bona fide Hong Kong resident.
